Sequestration is the term used in Scotland for personal bankruptcy.
Sequestration involves the transfer of your assets and property into the hands of a Trustee for the benefit of the your creditors.
Sequestration commences with a petition to the Sheriffs Court normally by a creditor and then a Trustee would be appointed to your case by the court. The Trustee is responsible for the transfer (sale) of all your assets (house, car, valuable items, savings and investments etc) for your benefit of your creditors
Many TDA customers are finding that a Scottish Trust Deed can help them avoid Sequestration. It is likely that a Trust Deed could be the answer to your severe debt problems, since it will provide much of the relief offered by Bankruptcy but without the severe constraints and restrictions which bankruptcy will imposes.
